Appeal by claimant (P) against CA decision (See Abs64050) that the defendant squatter (G) relying on Limitation Act 1980 s 15 had dispossessed the paper owner (P) by going into ordinary possession of the land for the requisite period without the consent of the owner. Held: appeal allowed. In determining the right of action of a paper title owner to recover possession of land which had become barred under s15 of the 1980 Act reference to adverse possession should be avoided and effect be given to the clear words of the Act.
