The defendant council eventually made it the subject of a compulsory purchase order. The inspector advised that the order be made, but expressed concern about the potential infringement of L's rights under Article 8 of the European Convention on Human Rights. L brought proceedings under the Land Act 1981 s23 to have the order quashed. "Held" the claim was dismissed.
