520 _aCA 26 July 2002. "West Hampstead Management Co Ltd v Pearl Property Ltd". Tenants of flats owned by Pearl Property Ltd (P) served notice of their intention to acquire the freehold of the property. The appellant company, West Hampstead Management Co Ltd (W) was to be the nominee purchaser. No agreement was reached as to the terms of the acquisition and the matter was referred to a leasehold valuation tribunal (LVT). This valued the property as at February 2000. Both parties appealed against the valuation to the LT which upheld the LVT finding as to the correct valuation date. W appealed contending that the correct valuation date was in fact May 1999. The appeal was dismissed with the valuation date being established as February 2000.
