520 _aExamines the process of limitation along with some relevant recent cases. Explains that the underlying policy is that a defendant should be spared the injustice of having to face a stale claim. Current legislation is contained in the Limitation Act 1980 and its provisions were examined in Brocklesby v Armitage & Guest and more recently in Cave v Robinson Jarvis & Rolf. Here it was decided that it was only when the defendant is aware of his own deliberate wrongdoing that it is appropriate to penalise him for failing to disclose it.
