Assets of finance company DFL were secured against moneys advanced to DFL by Midland Bank plc; these included 16 properties that had been taken as security for loans made by DFL to a property dealer (R). DFL was entitled to exercise a power of sale over the properties. Defendant firm (AG) carried out valuations and sold the properties. R complained they were sold at too low a value and started proceedings against AG.
