520 _a[2002] EWHC 1607 (QB), 31 July 2002. Assets of finance company DFL were secured against moneys advanced to DFL by Midland Bank plc; these included 16 properties that had been taken as security for loans made by DFL to a property dealer (R). DFL was entitled to exercise a power of sale over the properties. Defendant firm (AG) carried out valuations and sold the properties. R complained they were sold at too low a value and started proceedings against AG. Court decided that AG did owe R a common law duty in contract and tort to the receivers who had instructed it (for CA decision see Abs66380). View judgement at www.courtservice.gov.uk.
