520 _aCA, 15 October 2002. Respondent (S) compulsorily purchased land from appellant (P) to construct the Channel Tunnel Rail Link. Under the Land Compensation Act 1961 s5 the compensation award was to be the open market value of the land. The LT valued the land at £475 000 per acre. S had argued for £460 000 per acre and P for £638 015 per acre. The LT ordered S to pay three-quarters of P's costs on the grounds that it found P's suggested value to be very high. P appealed claiming this was not sufficient reason to disallow part of its costs. "Held": appeal dismissed on the grounds that P had escalated their costs by making unnecessary and unhelpful submissions.
