Under the Land Compensation Act 1961 s5 the compensation award was to be the open market value of the land. The LT valued the land at £475 000 per acre. S had argued for £460 000 per acre and P for £638 015 per acre. The LT ordered S to pay three-quarters of P's costs on the grounds that it found P's suggested value to be very high. P appealed claiming this was not sufficient reason to disallow part of its costs.
