Provides a detailed interpretation of the Town and Country Planning (Environmental Impact Assessment) (England and Wales) Regulations 1999 with reference to case law, highlighting the application of thresholds and criteria to decide whether a project requires EIA. Continues by examining case law on the following areas: attacks on decisions not to require EIA, focusing on the consideration of likely effects; the level of detail required in an environmental statement; whether EIA requirements apply to the stage of approval of reserved matters; and the timing of EIA challenges.
