LUL refused to make an undertaking, sought by the claimant (H), not to demolish Bishopsgate Goods Yard, a listed building. The question was whether the goods yard comprised of one building or several and if so, did the listing cover all of them. H applied for permission to bring about a judicial review proceedings to challenge LULs decision not to make an undertaking. It was decided that it was a matter for the local planning authorities to determine what, if any, enforcement action was appropriate. Held: the claim was allowed in part. | ||
