Appeal by the council (M) against the respondent (R) alleging that it had breached Building Regulations 2000 Reg12(2)(B) by extending retail areas at Manchester's Piccadilly railway station without obtaining building regulations approval as required by regulation 14. The magistrates found that R's activities fell within the statutory exemption contained in the Building Act 1984 s4(1)(b), which relieves statutory undertakers of the duty to submit plans for approval in relation to buildings used by them for the purpose of their undertaking, unless it is used as offices and not part of a railway station.
