Claimant (CIS) as employer claimed against main contractor (HB) and consulting engineer (CHW) for alleged breach of contractual obligations, under the to the JCT 80 Private with Quantities Contractors Designed Portion Supplement, after water and soil flooded sub-basement excavations. Although CHW produced a concept design for the substructure, earthwork, support and ground water exclusion, HB was held to be responsible for checking CHW's design. Due to a drafting error in the bills of quantities, HB was entitled to be paid for extra work under cl13.2 despite the design liability risk.
