Open market value was to be assessed under Land Compensation Act 1961 s5 rule 2. Y's valuation of £860 000 was based upon an assessment of what a purchaser would have paid by reference to receipts and expenditure. S's valuation of £671 873 was supported by a depreciated replacement cost valuation. LT held that £782 776 compensation should be paid. Value of land taken was £672 000. No compensation was payable for additional rent on the new premises. Y failed to prove claims for loss of revenue and the cost of advertising to bring back lost passengers.
