Appeal by the local planning authority (Maidstone BC) from the CA decision ([2001] EWCA Civ 100, [2002] 1 P&CR 493) that an enforcement notice served on the respondent's partially erected dwelling house had expired. The issue was the whether the enforcement notice was served within the four-year time limit imposed in relation to the completion of building operations under the Town and Country Planning Act 1990 s171B. "Held": appeal allowed. The inspector was correct in concluding that since the building had not been 'substantially completed' the enforcement notice had been served within the four-year time limit.
