520 _aExamines the issue of planning permissions for waste incinerators with reference to "R v Surrey CC ex p Adriano" ([2002] EWHC 2471;unreported). Surrey CC's decision to grant planning permission for an energy from waste incinerator at a landfill site was quashed on three grounds: the Council's Planning and Regulatory Committee had misinterpreted key provisions of the local plan: it had incorrectly applied the proximity principle; and it had failed to establish a need for the incinerator. Considers each of these factors and concludes that local authorities now face a 'no win' situation when trying to site incinerators.
