Claimant landlord (W) served defendant tenant (H) with terminal schedule of dilapidations and commenced proceedings claiming damages for breach of covenants in the lease and of covenants to reinstate under various licences. The licences required reinstatement of alterations when required by landlord. Two preliminary issues were raised. Firstly, did the schedule of dilapidations constitute a notice to reinstate under various licences to alter and secondly did cl5 of the lease restrict the tenant from making any alteration or addition to the building in its state at the date the lease was granted without the licence of the landlords. "Held": that the schedule of dilapidations referred to reinstatement under the licences and cl5 restricted H from making any alteration or addition whatsoever to the building as at the date the of the grant of the lease without the licence in writing of the claimant first being obtained.
