| 520 | _aIn "Marcq v Christie Manson and Woods Ltd" ([2003] EWCA Civ 731, 23 May 2003) the CA upheld auctioneers Christie Mansion Woods' (CMW) claim that it had acted in good faith in returning a painting unsold at auction to the prospective seller not knowing that he was not the rightful owner. Claim for conversion and bailment dismissed. The case has important implications for auctioneers highlighting the importance of due diligence. In this instance, CMW was able to prove that they had acted in good faith.
