However, environmental lawyers suggest there is plenty of scope for litigation under the regime, firstly with identifying the polluter and secondly with the extent of remediation required. These include the chemical sites of Bayer CropScience, Rhodia and Steetly, Manywells landfill site near Shipley in West Yorkshire and the discovery of hydrocarbon contamination during brownfield development at Neston in Cheshire.
