Progress to date has been slow with only two remediation notices served and local authorities remain wary about increases in workload and using untested statutory powers. However, environmental lawyers suggest there is plenty of scope for litigation under the regime, firstly with identifying the polluter and secondly with the extent of remediation required. Provides several case studies that highlight the extent and diversity of land contamination problems. These include the chemical sites of Bayer CropScience, Rhodia and Steetly, Manywells landfill site near Shipley in West Yorkshire and the discovery of hydrocarbon contamination during brownfield development at Neston in Cheshire. Also highlights contaminated land 'horror stories' and a rare example of a site being regulated under the regime as a result of Southampton council's programme of systematic inspections.
