HL upheld the CA decision ([2001] EWCA Civ 212, [2001] Env LR 763) that S was not liable for the cost of remedial work needed when a leak from a water main caused an embankment protecting and supporting T's gas main to collapse on the grounds that the piping of a water supply on S's land was an ordinary use of its land within the principles of "Rylands v Fletcher" [1868] LR 3 HL 330. The HL reviewed scope and application of "Rylands v Fletcher" concluding that the strict liability rule should not disregarded in favour of a fault based rule. Appeal dismissed.
