Appeal against HC decision ([2002] EWCH 2785 (Ch), X121051) by appellant (R) which held that public navigation rights existed over a stretch of the River Thames known as Hedsor Water and that the defendant (E) was entitled to perform its statutory functions with respect to Hedsor Water. CA upheld HC decision but noted that in exercising its public functions in respect of Hedsor Water, E should take into account the common assumption prior to to November 2000 that it was private. Appeal dismissed.
