Discusses in some depth the background to and the recommendations of the European Commission's "Management of construction and demolition waste working document no 1" for dealing with construction and demolition waste within the European Community. Reviews relevant legislation and case law within the UK together with an evaluation of their significance for the UK construction industry. Main issues raised include potential burdens on construction industry businesses, offences in connection with waste, duty of care and environmental liability for remediation of contaminated sites, definition of waste as interpreted by the courts, the effect on landfill regulation and taxes on development and operators and the recycling of inert waste and aggregates.
