Points out arrestment is a protective measure granted by the Scottish courts which freezes sums of money pending the outcome of a monetary claim. Also inhibition in Scotland allows freezing of a defender's interest in real estate pending the outcome of a claim. The Human Rights Act 1998 means these rights are no longer available. Proposed new rules look to redress these problems.
