Appellant (W) and three other partners in a farming partnership appealed against the amount of damages awarded against firm of solicitors (G) in a negligence action on the grounds of delayed completion. The judge awarded £591.75 damages to W representing interest from the contractual completion date until actual completion on the basis that W should have mitigated his losses by taking proceedings against vendor. CA in recognising that W would have had the chance of making a profit if completion notice had been served awarded damages of £4 238 for loss of profit.
