Another method, namely the application of an early payment discounted commission rate, was judged to be unfair in the recent case "Bairstow Eves London Central Ltd v Smith" ([2004] EWHC 263 (QB), [2004] PLSCS 47).Provision for double commission in the event of late payment is potentially unfair and unfair contractual terms are not binding on the consumer under the Unfair Terms in Consumer Contracts Regulations 1999 Reg 5(1).
