520 _aConsiders in some depth the guidance and interpretation of PPG15 paras 3.15A and 3.19 given in "Sullivan v Warwick DC" ([2003] EWHC 606, [2003] JPL 1545) with regards to the partial demolition of a listed building for which a planning permission and listed building consent had been granted. Paras 3.15.A and 3.19 had been amended following "Shimizu (UK) Ltd v Westminster City Council" (HL, Abs56626). "Shimizu" held that demolition of a listed building in the context of the Planning (Listed Building and Conservation Areas) Act 1990 involved the pulling down and removal of a whole building. Demolition of only part of a listed building was by contrast an alteration. Pays special attention given to the interpretation of paras 3.15A and 3.19 by English Heritage in its advice to Warwick DC who granted the consent for partial demolition.
