Paras 3.15.A and 3.19 had been amended following "Shimizu (UK) Ltd v Westminster City Council" (HL, Abs56626). "Shimizu" held that demolition of a listed building in the context of the Planning (Listed Building and Conservation Areas) Act 1990 involved the pulling down and removal of a whole building. Demolition of only part of a listed building was by contrast an alteration. Pays special attention given to the interpretation of paras 3.15A and 3.19 by English Heritage in its advice to Warwick DC who granted the consent for partial demolition. | ||
