Here it was established that the Working Time Regulations 1998 protected Redrow's bricklayers and gave them entitlement to holiday pay. Redrow had argued that its standard labour only subcontract document was a deal between them and their employee and that the government regulations did not apply in this case. The CA disagreed with this as in "Byrne Brothers (Formwork) Ltd v Baird and Others" (EAT/542/01, [2002] IRLR 96) it was proved that protection was to be extended to those who need it. The contractual relationship was personal and was inside the scope of the Regulations. | ||
