Appeal against LT decision (ACQ/128/2002, Abs67610) which held that any action involving a claim for injurious affection brought under the Land Clauses Consolidation Act 1845 s63 was time-barred under the Limitation Act 1980. On appeal, B submitted that L was prevented from relying on the limitation point due to the existence of an estoppel by convention, equitable estoppel or waiver. After considering the evidence, CA held that no estoppel had been established which prevented L from relying on the limitation defence. LT decision upheld. Appeal dismissed.
