Notes that some cover is available for consultants including a cost inclusive aggregate amount and for negligence claims only. Examines what can be done under Reg 4 of the Control of Asbestos at Work Regulations 2002 which apply to non-domestic premises. It sets out specific steps that a dutyholder has to take in relation to the assessment and in the event that asbestos is found. Argues that both consultants and clients need to realistically assess the risks and the availability of insurance cover. There must be clear terms of engagement regarding the scope of the consultants' duties and any limitation on consultants' liability should be agreed.
