Argues that the events of this dispute can form the basis of effective advice about future conduct in disputes about contracts. For example, in this case, the contract was not effective for the situation as it was a hybrid one which did not provide any incentives for the contractor. Also the need for mediation had been highlighted as the case was allowed to continue for a long time with many small claims making it very long and expensive to administer.
