520 _a[2004] EWCA Civ 1710, 21 December 2004. Discusses if an option to reassign a lease can be exercised by a landlord despite not having been the landlord throughout the option period. B brought proceedings to determine whether the option to require L to take back the property had been validly exercised and, if not, whether the option could be validly exercised if the lease were reassigned to all the claimants. The court found that the exercise of the option was invalid but B could exercise the option after they had reassigned the lease back to themselves. Both parties appealed. "Held": the appeals were dismissed, the judge was correct in his interpretation of the agreement.
