The new rules stipulate that before coming to court the pursuer should have set out to the intended defender the nature of the claim and supplied any copies of any documents relied upon. The defender is then expected to respond by setting out the nature of the defence and its facts and legal grounds. Adjudication could use these concepts by fully investigating the issues prior to the raising of an action.
