520 _aThe Land Registration Act 2002 (LRA) introduced the open register and, along with the Land Registration Rules 2003 (LRR), granted extensive rights to inspect, copy and request official copies of documents kept by the Land Registry. The system established by the LRA and the LRR will be complete in October 2005 when transitional period documents become available to the public. However there will still be documents which will not be available to the public as of right. The Freedom of Information Act 2000 (FOIA) may provide the rights to fill the gap in the open register system. It will depend on how the Land Registry interprets its obligations under the FOIA and, in particular, how it applies the public interest test for withholding information. The article looks at the rules governing access to Land Registry documents in the LRA and the LRR and then considers the rights granted by the FOIA and its impact on the Land Registry.
