520 _aWith reference to a recent CA decision, "George Wimpey UK Ltd v VI Construction Ltd" ([2005] EWCA Civ 77, The Times 16 February 2005) advises parties to be careful in the creation of contracts. They are often badly drafted, not checked for errors and once signed it is usually too late to rectify the problems. In "Wimpey" an enhancement factor was not properly included in the contract. An application was made to incorporate these, but VI Construction successfully appealed as the CA concluded that Wimpey had not offered convincing proof that VI had knowledge of Wimpey's mistakes.
