Largely driven by government concern about the anti-social behaviour associated with patrons of bars and nightclubs, the old A3 food and drink use class will be divided into three separate classes: restaurants and cafés; drinking establishments; and hot food takeaways. Describes the development of use classes. Examines the changes in detail and the guidance given in the accompanying ODPM Circular 3/2005. Looks at potential problems and also the issue of use classes in leases. Concludes that the government goal of maximum possible deregulation consistent with delivering planning policy objectives has been lost in the process of change.
