An enforcement notice had been served against a gypsy (S) using green belt land for his caravans. An inspector was appointed following S's appeal but found there was a lack of alternative sites and upheld the apeal. The SoS's decision to uphold the enforcement notice was successfully challenged on the grounds that the SoS had failed to consider evidence showing S had looked for alternative sites.
