This encourages parties to settle before they begin proceedings, but notes that this requires the parties to behave in a sensible commercial way. Notes that in some situations such as "Skanska Construction UK Ltd v Egger (Barony) Ltd" ([2005] EWHC 284 (TCC), unreported) the parties are still in dispute right up to the end. Recommends that the three C's are followed: resolve what you can contemporaneously; take a commercial approach to any dispute; and think about cooperating with the other side to work towards a resolution.
