Eversheds failed to inform Keydon that the property had been sublet: if advised correctly, Keydon would not have bought the property. Eversheds accepted that it had acted negligently but Keydon disputed the level of damages that it should receive, arguing that the amount should reflect what the amount would have been if they had been advised correctly rather than just being compensation for the money lost. The court agreed that this flexible approach was required and awarded £500 000.
