Tesco had gone ahead with a subletting to Magspeed despite their landlords', Crestfort and others, refusal on the grounds that the terms of the sublease contained watered-down provisions. Crestfort began proceedings to remove Magspeed and take out an injunction requiring Magspeed to surrender its lease to Tesco. The court agreed with the landlords and held that Tesco was in breach of covenant when it granted the subletting and also that Magspeed was liable in damages to Crestfort because it had interfered in the landlords and tenant contract. | ||
