The claimant house developer brought a charge against the defendant local authority that it had erred in law in adopting a local plan that was not in general conformity with the structure plan. The structure plan had a provision for the construction of a 1 000 homes but this provision was modified in the local plan to safeguard the land from development unless it could be strategically justified. The court upheld that the local plan was in general conformity with structure plan policy even where it contained a qualification as to the justification or timing of development referred to in the structure plan.
