520 _aDiscusses the case "Costain Ltd and others v Bechtel Ltd" ([2005] EWHC 1018 (TCC), unreported) concerning the duties of a project manager under the NEC contract. Costain, (C) operating as part of a consortium, Corber, had shown that they had serious issues to be tried over Bechtel's policy of administering the contract unfairly and adversely. However, when it came to the question of balance of convenience, C had failed to show that it was appropriate to grant an interim injunction. The case implies that a project manager needs to act impartially and in good faith.
