Wretham (W) claimed ownership through adverse possession as he and his predecessor had been possessed the land for over 30 years without the consent of the registered owners. A previous application had been refused and W decided to appeal arguing that the Land Registry had applied the wrong legal test. The court followed the HL decision in "J A Pye (Oxford) Ltd v Graham" and decided that the Land Registry had been wrong and W had acquired legal title to the land through adverse possession.
