260 _c2005
520 _a[2005] EWHC 1259 (Ch), 1 July 2005. Considered whether the Land Registry had applied the correct legal test to a claim for adverse possession. Wretham (W) claimed ownership through adverse possession as he and his predecessor had been possessed the land for over 30 years without the consent of the registered owners. A previous application had been refused and W decided to appeal arguing that the Land Registry had applied the wrong legal test. "Held": following the HL decision in "J A Pye (Oxford) Ltd v Graham" it was decided that the Land Registry had been wrong and W had acquired legal title to the land through adverse possession.
