520 _aDiscusses the case "Lafarge (Aggregates) Ltd v Newham LBC" [2005 EWHC 1337 (Comm) where there was a dispute over the interpretation of working days in a clause in a contract regarding the service of a notice. The dispute arose over the dating of a notice which was dated 13 October, a Saturday. The court decided that the arbitrator had actually made his decision in an email on 13 August and that consequently the arbitrator had no jurisdiction as the reference to him was not made in time in accordance to the contract provisions. It was also decided that the expression a working day referred to a normal office day and that a notice to refer to arbitration could have been served effectively on a Saturday.
