520 _aDiscusses "Beaulane Properties Ltd v Palmer" ([2005] EWHC 1460 (Ch), L129526) which radically changes the law of adverse possession but only in respect of claims to registered land completed within a limited timeframe. Makes the following key points: the Human Rights Act 1988 must be considered where a squatter has completed the required period of possession after 1 October 2000; the meaning of adverse possession has altered where adverse possession of registered land was completed after 1 October 2000 and before 13 October 2003; the post-2003 Land Registration Rules on squatters' rights are unlikely to be affected and squatters claims to unregistered land remain unaffected for the time being. "Beaulane" does not apply to claims where the period of adverse possession was completed prior to 2 October 2000 nor to unregistered land. "Beaulane" may be appealed.
