Discusses the duty to repair. Examines the application of the exception in s11(3) of the Act in "Montoya v Hackney LBC" (unreported, 15 July 2005), a case which illustrates the difficulty of distinguishing between those defects coming within the landlord's liability and those coming within the exception.
