Discusses the conditions to be met and looks at ways around the problem of s21(4) which stipulates that the notice must expire on the last day of a period of tenancy. Suggests that the consensus that a s21(4) notice must be served to a tenant remaining in occupation after expiration of a fixed term is wrong. Concludes that it is permissible to serve a s21(1) notice without complying with the extra requirements of s21(4).
