In "R and V Versicherung A G v Risk Insurance and Reinsurance Solutions S A and others" ([2004] EWHC 2682 (Comm), unreported), it was decided that damages can be recovered for diversion of internal resources caused by the defendant's breach even where no loss of income can be proved. Lost time and wasted expenditure has to be directly attributable to the breach, and must be quantifiable. It is therefore vital that those involved in rectification work keep accurate notes of time and money spent. | ||
