E applied pursuant to the Planning and Compulsory Purchase Act 2004 S113(3) to quash parts of a regional strategy published by the SoS as a statutory document. E had the option to purchase part of a site that lay within an administrative area to which the strategy applied. A specific allocation of 1500 dwellings for the site was made which the SoS removed when he published the strategy. The SoS conceded that errors had been made but argued that to quash the erroneous parts of the strategy document would create a policy gap not in the public interest. "Held": application granted. The parts of the strategy document containing errors should be quashed and the resultant policy gap filled by guidance issued under s19(2)(a).of the Act.
