At present, a company can only be found guilty of corporate manslaughter if a single senior person is also found guilty; the new Bill allows the courts to consider the overall pattern of senior managers' activities when assessing guilt. Upon conviction, a company faces the prospect of unlimited fines; the court can also order remedial action to be taken, and order a company to review its safety measures. The Bill also removes Crown immunity, placing government departments on an equal footing with the private sector. It is anticipated that the Bill will encourage contractors to tighten up their safety practices, in view of the possible negative impact of any manslaughter conviction on future business.
