520 _aExamines how the provisions of the Contracts (Rights of Third Parties) Act 1999 can be used to avoid the difficulties and inconveniences caused in the past by the need to issue collateral warranties. The Act confers on certain third parties the right to rely upon, and benefit from, the terms of a contract to which they were not a party. After an initial period of scepticism in the construction industry, the 2005 JCT Standard Building Contract now utilises the provisions of the Act, removing the additional administrative burden associated with the provision of warranties, and the temptation for warranty providers and beneficiaries to individually negotiate terms.
