Glasgow City Council and others (Appellants) (Scotland) Conjoined Appeals)
260 _C2006
520 _a[2006] UKHL 50, 16 November 2006. Concerned the compulsory purchase of a plot of land in Glasgow city centre by Glasgow City Council who entered into an agreement with a developer whereby the site would be transferred to the developer in exchange for the latter's undertaking to redevelop the site and indemnify the authority for the money expended in assembling the site and making it available. "Held": it was decided that the Council had acted within its powers (as set out in Town and Country Planning (Scotland) Act 1997) because of the site's poor condition, the Council's inability to fund the redevelopment itself and the lack of any suggestions by potential developers that they would be willing to pay more for the right to acquire the site than the amount of the indemnity.
