The tenant argued that the sums claimed by the landlord were not due under the lease, and also counterclaimed for damages, asserting that the repairs should have been carried out previously, and that the landlord was in breach of coventant to provide services. "Held": the judge upheld the tenant's counterclaim, as it was ruled that the landlord was in breach of its 'all reasonable endeavours' obligation due to the fact that the landlord had considerable prior knowledge that repairs were needed.
